Question: Can I remove furnishings I own from a home I'm renting?

I have a very bad renter. I'm in the process of evicting them from my home, which is actually on the market (we rented to lessen our financial burden). She never signed a lease, so we don't really have an agreement, yet I still chose the eviction course to get her removed. However, I'm worried she will steal furnishings that belong to me - curtains, curtain rods, light bulbs, a couch, a couple lamps - all items that were used for staging that were left in the house when she moved in. I did not foresee having these issues, but I want to ensure my assets are safe.

Given a 24 hour notice to enter the home, can I remove the items that belong to me?
Correction - I'm not renting the home - I'm "renting out" the home ;-)

Answer: No, you can not remove anything without a court order. You will never get her out if you screw this up. She does not need a lease to have rights, and she has rights to everything in the unit until a judge states otherwise.

You can enter, but not take anything out. Anything that was there when she moved in has to stay.
